  1. Definitions.
    1. Customer – a natural person, legal person or organizational unit that is not a legal person, whose special provisions grant legal capacity, who makes an order within the store.
    2. Civil Code-Act of 23 April 1964 (Journal of laws 1964 No. 16, item 93, as amended).
    3. Regulations – these regulations for the provision of services by electronic means within the online store www.tworzymyrazem.pl

    5. Goods – products presented in the online store.
    6. Sales agreement – an agreement for the sale of goods within the meaning of the Civil Code, concluded between Tvesd Plus SP.z O. o. and the customer, concluded using the online store's website.
    7. Act on Consumer Rights-Act of 30 May 2014 on consumer rights (Journal of laws 2014, item 827 as amended).
    8. Order – a statement of the customer's will, aimed directly at concluding a sales agreement, specifying in particular the type and number of goods.

  3. These Terms and conditions set out the rules for using the online store available at www.tworzymyrazem.pl
  4. Online store, operating under www.tworzymyrazem.pl, is operated by Tves Plus Sp z. o. o, ul. Poprzeczna 52G, 05-506 Lesznowola, NIP 1231523655, Regon 523906537.
  5. These regulations shall specify in particular:

* rules for registration and use of the account within the online store;

* terms and conditions of electronic booking of products available in the online store;

* terms and conditions for placing orders electronically within the online store;

* rules for concluding sales contracts using the services provided within the online store.

  1. Rules for using the online store.
  2. The purchase of the product does not require registration in the store.
  3. The information provided on the store's websites, including information about the products presented, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
  4. Placing an order is carried out using the form available on the store's website.
  5. Each customer registering and / or placing an order agrees to receive information related to the course of the transaction, notifications of changes in these Terms and conditions to the e-mail address provided by him.
  6. In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the online store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
  7. Procedure for concluding a sales agreement.
  8. In order to carry out any activity of the customer in the store, it is required to correctly operate the Internet, use a web browser, including mobile devices, and have an active account at the selected e-mail address.
  9. In order to conclude a sales agreement through the online store, you must go to the website www.tworzymyrazem.pl, make a choice by taking further technical actions based on the messages displayed to the client and the information available on the site.
  10. The store allows you to purchase products and services 24 hours a day, 7 days a week.
  11. The selection of ordered goods by the customer is made by adding them to the cart.
  12. When placing an order – until the "place an order" button is pressed – the customer has the opportunity to modify the entered data and to select the goods. For this purpose, you should be guided by the messages displayed to the customer and the information available on the site.
  13. In order to finalize the order, the customer is asked to provide all the necessary data needed to complete the order, i.e.:
  • first and last name / company name
  • delivery address
  • email

* contact phone number

* NIP – in case of request for VAT invoice.

  1. After the customer using the online store has provided all the necessary data, a summary of the order will be displayed. The summary of the submitted order will contain information on:
  • subject of the order:

* the unit and total price of the products or services ordered, including delivery costs and additional costs (if any);

* selected payment method;

* the chosen method of delivery.

  1. In order to send an order, it is necessary to accept the content of the regulations, provide personal data marked as mandatory and press the "place an order"button.
  2. Sending an order by the customer constitutes a declaration of willingness to conclude a sales agreement with Tvesd Plus SP.z O. o., in accordance with the terms and conditions.
  3. After placing and paying for the order, the customer receives an e-mail entitled “Order Confirmation”, containing the final confirmation of all relevant elements of the order.
  4. The agreement shall be deemed to have been concluded upon receipt by the customer of the e-mail referred to above.
  5. The sales agreement is concluded in polish, with the content in accordance with the terms and Conditions.
  6. Delivery issues in the online store.
  7. Prices of products in the store are in Polish zloty, include tax without shipping costs. Shipping costs are added to the sum of the ordered products and are borne by the customer. The final price binding the owner and the customer is the price of the product specified in the offer at the time of placing the order by the customer.
  8. Types and prices of supplies:

* Courier INPOST: 13 PLN / delivery time 1-2 working days download + 2 PLN;

* Parcel post: 13 PLN / delivery time 1-2 working days download + 2 PLN;

  • DHL courier: 17 PLN / delivery time 1-2 working days download + 2 PLN.
  1. Information about the total value of the order (including shipping costs, which are detailed in the delivery and returns tab) is available in the Order Summary on the product sales page and in the order confirmation. Delivery of goods is carried out both in the territory of the Republic of Poland and European countries and selected countries located on other continents to the address indicated by the customer during the order. The ordered goods are delivered by courier. The delivery deadline for orders with delivery in the territory of the Republic of Poland is two working days counted from the date of payment by the customer of the order. For orders with delivery outside the borders of the Republic of Poland, the delivery date is indicated with the information on the form of delivery and the country of destination. The customer along with the shipment will be provided with a printout of the confirmation and order specification and proof of sale. At The Express Request of the customer, a VAT invoice may be issued.
  2. Information about prices and payment methods in the online store.
  3. Prices of goods are given in Polish zloty and include all components, including VAT. The customer has the opportunity to choose one of the currently available payment methods:
  • by bank transfer to the seller's bank account;
  • via the Przelewy24 payment platform
  1. Withdrawal from the contract.
  2. The customer, who is a consumer within the meaning of Article 22 of the Civil Code, has the right – on the basis of legal provisions – to withdraw from a distance contract without giving any reason, by submitting a relevant statement in writing or by e-mail to sklep@handiwork.pl, within 14 days and sending them to the address of Tvesd Plus SP. z O.O. specified in these Terms and Conditions.
  3. In the event of withdrawal from a distance contract, the contract shall be deemed not to have been concluded. What the parties have provided is returned unchanged. Return should be made immediately, no later than within 14 days. The purchased goods should be returned to the following address: Tvesd Plus Sp z. o. o, ul. Poprzeczna 52G, 05-506 Lesznowola.
  4. The goods returned by the customer should be packed in an appropriate way, ensuring that the shipment is not damaged during transport.
  5. In case of withdrawal from this agreement, the store will refund the customer all payments received from it, including the costs of delivery of the goods (except for additional costs resulting from the delivery method chosen by the Customer other than the cheapest delivery method offered by the store), immediately, no later than 14 days from the date on which the goods were returned. The refund will be made using the same payment methods that the customer used in the original transaction, unless the parties agree otherwise.
  6. Returns and complaints policy in the online store.
  7. If the purchased product is not in accordance with the contract or has physical defects, the customer has the right to make complaints based on:

* regulations provided for by the provisions of the act of 27 July 2002 on special conditions for consumer sales and on amendments to the Civil Code (Journal of laws No. 141, item 1176, as amended). if the product is not in conformity with the contract;

* regulations provided for by the provisions of the civil code in the field of warranty for defects.

  1. In order to submit a complaint, the customer is obliged to inform the store by e-mail to www.tworzymyrazem.pl and then proceed according to the information received.
  2. When making a request under the procedure provided for in Article 1 (a), the customer shall have the right to request that the product be brought into conformity with the contract by means of repair or replacement free of charge, unless repair or replacement is impossible or involves excessive costs. If the store is unable to meet certain requirements, the customer has the right to demand a price reduction or may withdraw from the contract.
  3. When making a request under the procedure provided for in Article 1 (b), the customer shall have the right to withdraw from the contract or to request a reduction in the price. The customer may not withdraw from the contract if the store immediately, no later than within 14 days, replaces the defective item for a defect-free item or immediately removes the defects. This restriction does not apply if the item has already been replaced by the store or repaired, unless the defects are insignificant.
  4. The store is liable for non-compliance of the consumer product with the contract (Article 1 (a)), only in cases and under the conditions specified by law.
  5. The store is liable for defects in the product on the basis of the warranty (Article 1 (b)), in cases and under the conditions specified by law.
  6. The store considers complaints within 14 days from the date of receipt by the store of the complaint notification together with the complete advertised product.
  7. The store reserves the right to refuse to recognize the complaint in the event of any modifications to the product by the customer.
  8. The store reserves the right to refuse to recognize the complaint in cases of: the sole fault of the user, mechanical damage, improper preservation and use of the product in accordance with the instructions.
  9. The cost of shipping the claimed product in case of recognition of the complaint will be returned to the customer within 14 days from the date of recognition of the complaint.
  10. Privacy Policy and personal data protection.
  11. The condition for completing purchases in the store is to provide all the customer data required by the content of the form and mark the appropriate field (checkbox) constituting the customer's consent to the processing of his personal data by the owner and the field (checkbox) concerning confirmation of acquaintance and acceptance of these Terms and conditions.
  12. All customer data provided during registration in the store will be used only for the purpose of implementing, amending or terminating the agreement or other marketing activities, in particular to inform about new products and services of the store, if the customer agrees by ticking the appropriate box (checkbox) to send commercial information, using electronic means of communication within the meaning of the new regulation of the European Parliament and of the Council (EU) 2016/679 of 27.04.2016.
  13. All personal data of the customer will be processed by the owner in accordance with the content of the Act referred to above.

  15. Only personal data provided by the customer voluntarily is collected. The data are processed for the purpose necessary to comply with the provisions of these regulations, and in particular to conclude a contract of sale of the ordered goods, to deliver to the customer the goods for which the customer has placed an order, to issue a document confirming the transaction of sale of goods, to store personal data in an IT accounting system to ensure the history of commercial transactions made through the store.
  16. The data provided in the course of placing the order are also processed by the following entities in the specified scope: name, address, telephone, e-mail indicated as the delivery address are transferred to the shipping companies in the form of a label/waybill, which is also an order for delivery of the parcel.   4. Each user has the opportunity to subscribe to the newsletter-commercial information. Signing up for the list is done by selecting the appropriate field in the form at the registration stage (for this purpose only an e-mail address is needed). You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by informing the store by e-mail to Tvesdplus.22@gmail.com. after cancellation, the email address data will be immediately deleted from the subscription database.
  5. The store uses, among other things, so-called "cookies", which contribute to greater usability, functionality and ease of use of our store. These tools also make it easier for customers to move around the store faster. In addition, cookies allow you to measure the frequency of page views and the most viewed products.   7. All contents contained in the store are subject to legal protection and their use will constitute a violation of the law.
  8. In matters not regulated in these regulations, the provisions of Polish law, in particular the Civil Code and the provisions of the act on special conditions for consumer sales and amending the Civil Code of 18 July 2002 (Journal of laws 2001 No. 144 item 1204), the provisions of the act on consumer rights of 30 May 2014 (Journal of laws 2014 item 827, as amended); and other relevant provisions generally applicable law.
